SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE

Notice is hereby given that default has been made in the payment of that certain indebtedness (the “Indebtedness”) due from Robert E. Hamill (the “Debtor”) to First Community Bank, a state chartered bank organized under the laws of Virginia, successor-in-interest to Highlands Union Bank pursuant to merger, (the “Lender”), secured by an Open-End Deed of Trust and Security Agreement dated December 19, 2016 from Robert E. Hamill (the “Grantor”), to Bryan T. Booher, Trustee, recorded in Book 4859, Page 575, Register’s Office Sevier County, Tennessee, (the “Deed of Trust”). The Lender, being the true and lawful owner and holder of the Indebtedness, has exercised its option to declare the entire Indebtedness due and payable and has made demand for foreclosure pursuant to the Deed of Trust. Therefore, I, the undersigned, Substitute Trustee by virtue of appointment as Substitute Trustee in place of the original Trustee by an instrument dated May 14, 2026, of record in Book 6948, Page 59, Register’s Office, Sevier County, Tennessee, acting under the authority vested in the Substitute Trustee by the Deed of Trust, or my agent appointed pursuant to T.C.A. §35-5-114(a), will be at the front door (Court Avenue entrance) of the Sevier County Courthouse (125 Court Avenue, Sevierville, Sevier County, Tennessee) on August 18, 2026 at 11:00 a.m. (prevailing Eastern Time) to sell to the highest and best bidder, for cash and upon the Terms of Sale set forth below, at public auction in bar of and free from all rights of redemption afforded by statute, equitable rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other rights waived by the Deed of Trust, the Real Property (as defined herein). The phrase “Real Property” as used herein shall mean all of the Grantor’s right, title and interest in and to the following described real property (together with all existing or subsequently erected or affixed improvements and fixtures, all appurtenant easements and rights of way, and other appurtenances) described as follows:

SITUATED in the Fifth (5th) Civil District of Sevier County, Tennessee, within the corporate limits of Pigeon Forge, and being all of Lot 30 and Lot 31, Marshall Addition No. 4, as the same are shown on the plat of record in Map Book 2, Page 234, Register’s Office, Sevier County, Tennessee, to which plat specific reference is hereby made for more particular description.

BEING the same property conveyed to Robert E. Hamill by quit claim deed from Marlene K. Hamill dated October 31, 2016 and recorded November 1, 2016 in Book 4823, Page 322, Register’s Office, Sevier County, Tennessee.

SUBJECT TO the restrictions set out in the conveyance of record in Warranty Deed Book 117, Page 30, Register’s Office, Sevier County, Tennessee.

The Real Property address is believed to be 3211 Butler Street, Pigeon Forge, TN 37863. The tax map identification number is believed to be Ctrl. Map 094D, Group B, Parcel 043.00. The Real Property legal description shall control in the event of any inconsistency among the legal description, address, or tax map identification number.

The Real Property is being sold “AS IS WHERE IS WITH ALL FAULTS” without warranty or representation by the Substitute Trustee. All rights and equity of redemption, afforded by statute or common law, homestead, dower and all other exemptions are expressly waived by the Grantor in the Deed of Trust and title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. Title is to be conveyed subject to all liens, easements, covenants, conditions, encumbrances, and restrictions prior to the Deed of Trust that may exist including, without limitation, any unpaid ad valorem taxes or other taxes.

The proceeds of the sale will be applied in accordance with the terms of the Deed of Trust. The right is reserved to adjourn the day of sale to another day and time certain, without further publication or notice of any kind, upon announcement of said adjournment on the day and time and at the place set forth above, and to sell to the second highest bidder (at the second highest bidder’s highest bid) in the event the highest bidder does not comply with the terms of the sale.

TERMS OF SALE. The Real Property will be sold for cash upon the following terms: (i) the successful bidder shall pay, on the day of and at the place of the sale, a good-faith deposit equal to ten percent (10%) of the successful bidder’s final bid amount, which deposit shall be applied to the purchase price at closing; (ii) the balance of the purchase price shall be due and payable in full at closing, which shall occur within fifteen (15) days of the date of sale, on such other date as may be set by the Substitute Trustee, or as otherwise agreed between the Substitute Trustee and the purchaser; and (iii) in addition to the final bid amount, the successful purchaser shall pay a buyer’s premium equal to ten percent (10%) of the final bid amount, which buyer’s premium shall be added to the final bid amount to determine the total purchase price payable by the purchaser at closing. The successful purchaser shall also be responsible for all recording costs, any owner’s title examination or title insurance the purchaser may desire, all costs of securing funds to close, and all unpaid real property and personal property taxes, together with any other costs required of the purchaser under the terms of sale. This sale is subject to a reserve, and the Lender reserves the right to establish or approve a minimum or reserve bid and to submit a credit bid at the sale. The Substitute Trustee reserves the right to reject any and all bids. Prospective bidders are responsible for conducting their own due diligence prior to the sale and shall have no right of physical access to the Real Property prior to the date of sale. The Real Property will be conveyed by Substitute Trustee’s Deed, without covenant or warranty, express or implied, and closing shall be conducted pursuant to an agreement to purchase real property to be provided by the Substitute Trustee.
